Article 1 – Definitions
"Seller" refers to ACOM Structure LLC, operating the ArkenX brand and website.
"Customer" refers to any adult individual or business entity purchasing a Product through the Site.
"Consumer" refers to any individual purchasing for personal, non-commercial use.
"Products" refers to all goods offered for sale on the Site.
By placing an order on the Site, the Customer agrees to these Terms of Sale in full.
Article 2 – Scope & Applicability
These Terms of Sale govern all purchases made through thearkenx.com.
The Seller reserves the right to modify these Terms at any time. The Terms applicable to any given order are those in effect at the time the order is placed.
These Terms of Sale are to be read in conjunction with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Terms of Service.

Article 4 – Products, Availability & Visuals
ArkenX makes every effort to accurately describe and represent its Products. Slight variations in color or appearance may occur due to screen settings, lighting conditions, or photography angles.
All offers are valid while visible on the Site and subject to stock availability. The Seller reserves the right to discontinue any Product without prior notice.
Article 5 – Pricing
All prices are displayed in US Dollars (USD), excluding applicable taxes and shipping fees. Taxes are calculated and displayed at checkout based on your shipping address, in compliance with applicable US state tax law.
Prices may be modified at any time without prior notice. The price applicable to any order is the price displayed at the time of purchase.
Article 6 – Order Process
Placing an order involves the following steps:
- Add to cart
- Enter contact and shipping information
- Select shipping method
- Review order summary, accept Terms, and complete payment
An order summary is displayed before payment, allowing the Customer to review and correct any errors. The sale is final upon successful payment confirmation.
ArkenX reserves the right to refuse any order that is abnormal, fraudulent, or placed in bad faith. Electronic records (orders, invoices, payment confirmations) constitute valid proof of transactions.
Article 7 – Payment
Payment methods available at checkout include credit/debit cards, Apple Pay, PayPal, Shop Pay, and other options displayed during the checkout process. All payment providers are PCI-DSS certified.
Where Buy Now, Pay Later options are available (e.g., Klarna, Affirm), certain contact and order data may be shared with the relevant provider to assess eligibility. That provider's own privacy policy governs the use of such data.
Article 8 – Shipping & Delivery
Shipping zones, methods, estimated delivery times, and costs are displayed at checkout before payment is finalized.
Unless otherwise stated, orders are shipped within 1–2 business days of payment confirmation. Full shipping details are available in our [Shipping Policy].
Upon delivery, if a package arrives damaged or opened, Customer should document the damage and contact us at contact@thearkenx.com within 48 hours of receipt.
For international orders, the Customer acts as the importer of record and is responsible for any applicable customs duties, import taxes, or local fees.
In the event of a returned shipment due to an incorrect address or non-collection, reshipping may be arranged upon payment of a new shipping fee.
Article 9 – Transfer of Risk
Risk of loss transfers to the Customer upon delivery of the package to the carrier. Until that point, Products travel at the Seller's risk.
Article 10 – Returns & Refunds
ArkenX offers a 30-day return window from the date of delivery for unused items in original condition and packaging.

Items that have been used, worn, or removed from sealed packaging are not eligible for return. Return shipping costs are the Customer's responsibility, except in cases of Seller error or defective product.
Refunds are issued to the original payment method within 3–5 business days of receiving and inspecting the returned item.
Article 11 – Defective or Incorrect Items
If you receive a defective, damaged, or incorrect item, contact us immediately at contact@thearkenx.com with your order number and a photo of the issue. We will arrange a replacement or full refund at no additional cost to you.
Article 12 – Legal Warranties & Consumer Protections
ArkenX products are sold with the following protections under applicable US law:
Implied Warranty of Merchantability: Products are fit for their ordinary intended purpose.
Implied Warranty of Fitness for a Particular Purpose: Where the Seller has reason to know the Customer's specific intended use, Products are warranted to be fit for that use.
FTC Consumer Protection: ArkenX complies with the Federal Trade Commission Act and all applicable US consumer protection regulations. Customers have the right to dispute unauthorized charges with their payment provider.
These protections apply regardless of any additional commercial warranty offered on specific product pages.
Article 13 – Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACOM STRUCTURE LLC SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM:
- IMPROPER OR UNAUTHORIZED USE OF PRODUCTS
- HARDWARE OR SOFTWARE INCOMPATIBILITY
- SITE UNAVAILABILITY OR TECHNICAL FAILURES
- INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND
- EVENTS OF FORCE MAJEURE
THE CUSTOMER IS SOLELY RESPONSIBLE FOR SELECTING PRODUCTS APPROPRIATE FOR THEIR INTENDED USE.
IN NO EVENT SHALL ACOM STRUCTURE LLC'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE ORDER GIVING RISE TO THE CLAIM.
Article 14 – Intellectual Property
All content on the ArkenX website — including text, images, logos, graphics, videos, and databases — is protected under US and international intellectual property law, including the Digital Millennium Copyright Act (DMCA).

Article 15 – Personal Data & Cookies
The collection and processing of personal data and the use of cookies are governed by our [Privacy Policy], available on the Site.

Article 16 – Dispute Resolution
In the event of a dispute, we encourage Customers to contact our support team first at contact@thearkenx.com — most issues are resolved quickly and informally.
If a resolution cannot be reached, disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in English in the State of Wyoming.
Class action waiver: Customers waive the right to participate in any class action lawsuit or class-wide arbitration proceeding against ACOM Structure LLC.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
Customers may also file a complaint with the Federal Trade Commission (FTC) at ftc.gov/complaint or the Better Business Bureau (BBB) at bbb.org.
Article 17 – Force Majeure
Neither party shall be held liable for failure to perform its obligations due to an event of force majeure — including but not limited to natural disasters, pandemics, large-scale network outages, labor disputes, or government actions.
If a force majeure event persists for more than 90 days, either party may terminate the affected sale in writing without penalty.
Article 18 – Severability, Evidence & Language
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Electronic communications (emails, system logs, order confirmations) constitute valid proof of transactions and agreements.
These Terms of Sale are written in English. In the event of any conflict with a translated version, the English version shall prevail.
Article 19 – Commercial Warranty
Unless otherwise stated on a specific product page, no additional commercial warranty beyond the legal protections described in Article 12 is provided.
Any commercial warranty offered on a specific product will be detailed on that product's page, including its duration, scope, and applicable conditions.
