Article 1 – Definitions
“ Seller ”: ARKENX, operator of the Site.
“ Customer ”: any adult or professional individual purchasing a Product on the Site.
“ Consumer ”: any natural person acting for purposes outside their trade, business, or profession.
" Products ": goods offered for sale on the Site.
" Services ": services offered, where applicable, on the Site.
Accessing and ordering on the Site implies unreserved acceptance of these Terms and Conditions.
Article 2 – Scope of application – Enforceability
The Terms and Conditions govern all sales made via the Site.
The Seller may modify them at any time; the applicable terms and conditions are those in effect on the date of the order .
The legal notices, terms of use and privacy policy supplement these terms.

Article 4 – Products, availability and visuals
The products offered are described and illustrated with the utmost care. Slight variations in appearance (screen, lighting, angle) may occur.
Offers are valid while they are visible and subject to availability. The Seller reserves the right to withdraw a Product from sale.
Article 5 – Price
Prices are shown in euros inclusive of all taxes, excluding delivery charges which are displayed before validation.
Any change in VAT may be reflected in the prices. The applicable price is the one displayed at the time of the order .
Article 6 – Order – Process

Before payment, a summary allows you to correct any errors.
The sale is finalized upon validation of payment by the Customer. The Seller reserves the right to refuse any abnormal, fraudulent, or bad-faith order.
Computerized records (orders, invoices, payments) constitute proof of transactions.
Article 7 – Payment
Payment methods offered at checkout (e.g., credit card, Apple Pay, PayPal, etc.), operated by PCI-DSS certified providers.
In the case of split payment options (e.g. Klarna), certain contact and order data may be transmitted to the provider to assess eligibility; their processing is governed by the provider's privacy policy.
In the case of a bank transfer, shipping begins upon receipt of funds .
Article 8 – Delivery
Zones, modes, indicative times and costs are displayed during checkout.
Unless otherwise stated, delivery will take place no later than 30 days after the order is placed by a Consumer.
Upon receipt, in case of any anomaly (damaged/open package), make precise written reservations on the carrier's note and contact support promptly.
For deliveries outside the EU, the Customer acts as importer and bears any applicable duties and taxes.
In case of return by carrier (incorrect address, failure to claim), reshipment may be offered after payment of the new fees.
Article 9 – Transfer of Risks
The risk of loss is transferred to the Customer upon delivery of the package. Until such delivery, the Products travel at the Seller's risk.
Article 10 – Right of withdrawal (Consumers)
The Consumer has a legal right of withdrawal of 14 days from receipt.
To exercise this right, the customer must notify the company of their decision (by email or using the form below). They then have an additional 14 days to return the product.
Products must be unworn, unwashed, in their original sealed packaging , and complete. For hygiene reasons, items that have been worn/tried on without protection or that have been unsealed will not be accepted for return.
Unless the Seller is at fault, the return shipping costs are the responsibility of the Customer .
The Seller will refund all payments received (excluding return shipping costs) no later than 14 days after notification, but may defer the refund until the Products are effectively received or proof of shipment is provided by the Customer.
The refund will be issued via the same payment method , unless otherwise agreed, at no cost.
The Client may be held liable for any depreciation resulting from handling other than what is necessary for testing.

Article 11 – Returns outside the right of withdrawal
The return/exchange procedures (defective, preparation error) are detailed in the Return and Refund Policy available on the Site.
Article 12 – Legal Guarantees
The Products benefit from:

Under the legal guarantee of conformity (art. L.217-3 et seq. Consumer Code): the Seller is liable for any lack of conformity appearing within 2 years of delivery. The Consumer has the right to have the goods brought into conformity (repair or replacement) or, failing that, to a price reduction or to rescind the sale ;

of the guarantee against hidden defects (art. 1641 et seq. Civil Code): action within 2 years from the discovery of the defect, allowing the termination or reduction of the price.
These guarantees apply independently of any commercial warranty that may be offered.
Article 13 – Liability
The Seller cannot be held liable in the event of misuse of the Products, material incompatibility, unavailability of the Site, indirect damages or force majeure (art. 1218 Civil Code).
The choice of product is the responsibility of the customer.
Article 14 – Intellectual Property
The Site and all of its elements (texts, images, logos, charters, videos, databases) are protected.
Any unauthorized reproduction, representation, adaptation or extraction is prohibited.
Article 15 – Personal Data and Cookies
The processing of personal data and the use of cookies are described in the Site's Privacy Policy (GDPR rights: access, rectification, erasure, restriction of processing, objection – particularly to marketing – data portability, withdrawal of consent). Contact: contact@thearkenx.com .
Article 16 – Mediation and dispute resolution (Consumers)
In the event of a dispute, the Customer should first contact customer service to seek an amicable solution.
If no solution is found, the consumer can use the services of a consumer mediator free of charge. The terms and contact details of the competent mediator are available upon request and/or via the European ODR platform: https://ec.europa.eu/consumers/odr .
These terms and conditions are governed by French law . The competent French courts shall have exclusive jurisdiction in the event of any dispute.
Article 17 – Force majeure
Any external, unforeseeable, and irresistible event suspends the performance of obligations for its duration. If the force majeure event exceeds 90 days , either party may terminate the sale in writing, without compensation.
Article 18 – Partial Nullity – Evidence – Language
The invalidity of one clause does not affect the validity of the others. Electronic communications (emails, system logs) constitute proof. The General Terms and Conditions are written in French .
Article 19 – Specific commercial guarantee (if applicable)
Unless otherwise stated, no additional commercial warranty is provided. Any applicable commercial warranty is detailed on the product page (duration, scope, terms).
